Overview

These Terms & Conditions (“Terms”) are a legal agreement between you and Nutrivore Pte. Ltd. (“Nutrivore,” “we,” “us,” or “our”). We make our website (“Website”) available in order to provide you with information about our company, products and services, and also so that you can order our products. Your use of the Website, our products, and our service (collectively, the “Services”), are subject to these Terms.

BY USING THIS SITE AND OUR SERVICES, YOU SIGNIFY YOUR ACCEPTANCE AND WILL BE DEEMED TO BE BOUND BY THESE TERMS.

Acceptance of These Terms

By using our Website and Services, you confirm that you accept these Terms and that you agree to comply with them. Our Services are intended for offer in Singapore only. Any users outside of this jurisdiction should not sign up to the Website or order any products. If you do not agree to these terms, you must not use the Website or any of our Services.

Membership & Account Management

To purchase any products and for us to create a meal plan for your dog(s), we require you to register with us. Registering with us creates a user account (“Account”) for you and your dog(s). You may login to your Account at any time using the email address you registered with. You must ensure that the details you provide to us are accurate and complete. You must promptly inform us of any changes to the information that you provided us with. This includes your payment details - if we are unable to deduct payment from your card then we will be unable to process your order and it will be cancelled. You are responsible for all purchases made through your Nutrivore Account. Therefore, it is your responsibility to keep your Account safe. Your responsibility for maintaining the confidentiality and security of your Account includes, among other things: not sharing your password/OTP, not letting anyone else access your Account, and not taking other actions that might jeopardise the security of your Account. If you know or suspect that anyone other is able to access you Account, you must promptly notify us. Accounts are non-transferrable and you cannot assign, transfer, trade or sell your Account to any other party. To register with us, you must be at least 18 years of age. You agree not to impersonate any other person and not to conduct yourself in an offensive, illegal, immoral or offensive manner whilst using our Website. We reserve the right in our sole discretion to disable your Account at any time if you violate these Terms.

Communication

By giving us your email address you consent to receiving electronic communication directly from us. This communication can be directly related to your purchase or direct marketing from us. All information, disclosures, notices and agreements we communicate to you via email, WhatsApp or via the website are considered in writing.

Orders & Subscription

Our website is solely for the promotion of our products in Singapore. Currently, we do not accept orders for delivery outside of Singapore. When you make your first purchase of a meal subscription with us, you will automatically be subscribed to a regular order of meals from Nutrivore and this will continue until cancelled. Our subscription plan consists of an initial charge followed by recurring periodic charges. You acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Payment for all products must be by credit or debit card. You may cancel your upcoming order at any point before the scheduled billing, which can be viewed by logging into your Account. Requests to cancel after an order has been billed are not subject to refunds.

If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be for reasons including, but not limited to: the product is out of stock, unexpected limits on our resources which we could not reasonably plan for, we have identified an error in the price or description of the product, or we are unable to meet a delivery. When we customise a meal plan for your pet, this is based on specific profile information provided by you that may be subject to changes over time. You must keep us informed of any changes in order for us to make adjustments to the meal plan when required. If you cancel your Nutrivore meal plan and reactivate at a different time, the subscription price may differ.

Product

The images of the products on our website are for illustrative purposes only and the packaging of the product may vary from that shown in images on our Website. All products available on the Website are for personal use only. You may not resell any of the products that you purchase or receive from us. With each delivery, the number of packs of each recipe you have chosen may vary. All of our products are freshly made and the exact weight of each individual item may vary slightly. Our meals are designed to be nutritionally complete and balanced for healthy dogs. If your dog has a medical condition, requires a specific diet, or you are unsure whether your they will do well on our food, please consult a vet for advice before making the switch.

Deliveries & Returns

We reserve the right not to deliver to all locations and upon receiving your delivery details we will inform you if we cannot deliver to your selected address. Recurring deliveries run on a regular schedule with a time slot reserved for you. We require at least 24 hours notice if you need to change your delivery slot or location. Our deliveries run within pre-designated time slots on Thursday, Friday & Saturday. We may not be able to accommodate specific delivery requests, and any deliveries outside of these timings will be charged an additional delivery fee of $12.

If no one is there to receive the delivery, it will be left on the doorstep, if the doorstep is accessible to the driver. If the doorstep is not accessible, redelivery will be charged at an additional $12.

Our meals are delivered to you frozen. If you are ever unhappy by the temperature at which the product has been delivered, you must notify us on the same day of delivery by email (hello@nutrivore.sg) or WhatsApp (+65 91293902). Our products are perishable and once delivered you must take all steps necessary to ensure that they are stored according to our recommendations. We advise against leaving your delivery on your doorstep, and will not be liable for any products which spoil due to poor storage after they have been delivered.

Pausing and Cancellation

You can pause or cancel your subscription at any time by contacting us by email (hello@nutrivore.sg) or WhatsApp (+65 91293902). This must be done before the billing for your upcoming delivery, otherwise the delivery will still be charged and delivered. We reserve the right to refuse or cancel subscription orders at our sole discretion. If we do this, you will only be charged for orders that have been delivered to you.

All Website and promotional content is protected by copyrights, trademarks, service marks, and other proprietary rights that are owned by us or by third parties that have licensed their use to us. You may view and use the content only for your personal information and for using the Website, and for no other purpose, including but not limited to, any commercial purpose, and you shall retain intact all copyright and other proprietary notices. Any use of the content, except as specifically permitted in these Terms or as otherwise expressly permitted in writing signed by us, is strictly prohibited. Certain content, products and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites.

Limitation of Liability

You acknowledge that your use of this site and its content is at your own risk. You acknowledge that the feeding guides and meal plan recommendation provided by Nutrivore is intended as a guide only. It is your responsibility as a pet owner to monitor your pet’s weight and condition, and to let us know of any changes in weight or condition as these may impact your plan. We do not offer medical advice. If you have any concerns about your pet please consult your vet. You expressly agree that your use of, or inability to use, the service is at your sole risk. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We reserve the right to suspend, withdraw, discontinue, or change all or any part of our Services without notice. We will not be liable to you if for any reason our Services are unavailable at any time or for any period. In no case shall Nutrivore, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Indemnification

You agree to defend, indemnify, and hold harmless Nutrivore, its vendors and their affiliates and related entities, and their respective directors, officers, employees, and agents from and against all claims, losses, damages, liabilities, and costs (including, without limitation, reasonable attorneys’ fees and court costs), arising out of or relating to Your breach of these Terms, Your access to or use of the Website or the Services, or Your violation of any third-party right. You hereby release Nutrivore from any and all claims or liability related to any product or service of Nutrivore and any conduct, action, or inaction by Nutrivore.

Changes to These Terms

We may occasionally update these Terms. When we do update these Terms, we will also revise the “Last Updated” date at the top of these Terms. If we make changes to these Terms that, in our discretion, we consider significant, we will post the updated Terms on the Website and we may also send emails to our subscribers containing a link to the revised Terms. If You continue to use the Website or the Service after we post an update to these Terms, You indicate Your acceptance of the updated Terms.

Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Singapore, who will have exclusive jurisdiction.
